Common Questions
Do I legally need a privacy policy in Canada?
If you collect personal information from customers or users, in practice yes. PIPEDA requires you to make information about your privacy practices readily available, and Quebec requires a business that collects personal information through technological means to publish a privacy policy on its website.
Are terms of service legally required in Canada?
No general law requires them, but most products with accounts, payments or user content need them in practice. Shopify requires its merchants to post terms of service, and selling online to Ontario consumers brings in disclosure rules under the Consumer Protection Act, 2002.
Do these replace our terms of service?
No. They usually sit alongside your terms of service or SaaS agreement, either as a section within them or as separate terms.
Does CASL apply to onboarding emails?
Messages that only give factual information about an account the person already has, or deliver something they are already entitled to, are exempt from the consent requirement. Once a message also promotes an upgrade or a paid feature, treat it as commercial.
